Before using the Store, please read the Terms and Conditions. Acceptance of the Terms and Conditions is voluntary, but necessary to place an Order and use the Store. Each use constitutes acceptance of the provisions below.
1. Definitions
Shop – e-commerce website available at www.maliwojownicy.com along with subpages.
Seller / Administrator – BaseElektric – Artur Idasiak , ul. Leszczyńskiego 4/29, 50-078 Wrocław , NIP 8952003168 , REGON 387702759 , e-mail: modernwallartcompany@gmail.com .
Customer – a natural person (also an entrepreneur with consumer rights), a legal person or an organizational unit with legal capacity.
Product – a movable item presented in the Store, which is the subject of the Sales Agreement.
Working day – Mon.–Fri., excluding public holidays.
Shopping Cart – a Store function that allows you to place an Order, view costs and delivery details.
Order – a declaration of will by the Customer leading to the conclusion of a Sales Agreement (a separate offer for each Product).
Sales contract – a sales contract within the meaning of the Civil Code concluded remotely through the Store.
Order Confirmation – Seller’s declaration of acceptance of the offer and conclusion of the Agreement (e-mail).
Price – gross price of the Product, excluding delivery costs (which we provide separately).
The arrangement of concepts and the logic of their use corresponds to the scheme in your template.
2. Preliminary provisions and technical requirements
2.1. The store is run by BaseElektric – Artur Idasiak .
2.2. To use the service, you need: a device with internet access, an up-to-date browser (Chrome/Firefox/Edge/Safari/Opera), JavaScript and cookies enabled, and an active email address.
2.3. The information in the Store constitutes an invitation to conclude a contract within the meaning of Article 71 of the Civil Code, and not an offer.

3. Electronic services in the Store
3.1. We provide free of charge: (a) a Shopping Cart, (b) the ability to place an Order/contract, (c) displaying content (including tailored advertisements with consent), (d) optionally rating Products.
3.2. The Cart service lasts only once – until the Order is placed or the process is abandoned.
3.3. The shopping cart can remember selected Products (up to 30 days) according to cookie settings.
3.4. The Customer undertakes, among other things, to: provide true data, update it, use the Store in accordance with the law, not send illegal content, pay the Price and receive the shipment on time.
3.5. Complaints regarding electronic services can be directed to modernwallartcompany@gmail.com (describe the circumstances, request and contact details – this will facilitate service).
3.6. We will respond promptly, no later than 14 days (for consumers).
3.7. In the event of gross violations, we may temporarily restrict the Store's functionality, with prior notice to the Customer via email/message. The content and procedure are consistent with your template.
4. Product reviews
4.1. We encourage you to provide feedback (e.g. on a star rating scale).
4.2. By submitting a review, the Customer grants the Seller a non-exclusive, royalty-free license to use it for the purpose of promoting the Products and the Store (including online), with the right to edit it to the extent necessary. Reviews may be presented in an anonymized and aggregated form. License terms reproduced from your matrix and simplified for clarity.
5. Conclusion of the Sales Agreement (steps)
5.1. The Customer adds the Product(s) to the Cart → "Proceed to checkout".
5.2. Complete the following data: e-mail, name and surname, delivery/billing address, telephone number.
5.3. Selects delivery and payment (e.g. BLIK, card, payment operator).
5.4. Places an Order ( "Pay" button), accepting the Regulations.
5.5. Depending on the payment method, you will be redirected to the payment operator; the payment made constitutes an advance payment settled after the Order is accepted.
5.6. After placing the Order, we send an automatic Order Confirmation via email – at this moment the Sales Agreement is concluded.

6. Payments and sales document
6.1. Available payment methods are presented at checkout (they may depend on the value/scope of the order).
6.2. Settlements are made through authorized payment processors based on their terms and conditions. Placing an order without payment is not possible.
6.3. Proof of purchase (receipt/invoice) is sent electronically via email. This section is based on your template.
7. Delivery of products
7.1. We deliver within Poland (other countries upon agreement).
7.2. Delivery is subject to a charge unless the terms of the promotion state otherwise; the full cost will be shown in the shopping cart and in the summary before purchase.
7.3. Delivery time = preparation time + carrier time. Standard shipping time is 1–3 business days , unless otherwise indicated on the Product card/checkout.
7.4. The tracking number is sent via email after shipment. The points are constructed according to the matrix.
8. Complaints (non-conformity of the goods with the contract)
8.1. We are liable to consumers and so-called entrepreneurs with consumer rights for non-conformity of goods with the contract in accordance with the Consumer Rights Act.
8.2. You may first request repair or replacement . If these are impossible or excessively expensive, you may request a price reduction or withdraw from the contract in statutory cases.
8.3. Submit your complaint by email to modernwallartcompany@gmail.com – Please provide your order number, description of the defect, and photos. We will respond within 14 days ; failure to respond within this timeframe will constitute acceptance of the consumer's request.
8.4. If repair/replacement is warranted, we will collect the goods at our expense and complete the process without undue inconvenience to you. The scope and order of rights are consistent with the content of your document.

10. Withdrawal from the contract (returns)
10.1. The Consumer has 14 days to withdraw from the Sales Agreement without giving any reason (counted from taking possession of the item; in the case of multiple items – from the last item).
10.2. To meet the deadline, it is sufficient to send the declaration before the 14-day period expires (by email or post). You may use the template in Appendix 1 or your own clear declaration.
10.3. We will refund all payments (including the cost of the cheapest standard delivery) no later than 14 days from receipt of the declaration – we may withhold the refund until we receive the item or proof that it has been sent back.
10.4. Return the item immediately, no later than 14 days from the date of withdrawal. The direct costs of return are borne by the Customer (unless we agree otherwise).
10.5. You are responsible for any reduction in the value of the item resulting from its use beyond the necessary scope of inspection.
10.6. Exclusions: including personalised products; sealed items after opening for hygiene reasons; digital content not on a carrier when the provision was commenced with consent before the expiry of 14 days – in accordance with the Act.

11. Content rights (licenses)
Exclusive rights to the Store's content (including trademarks, graphics, and descriptions) belong to the Seller or authorized entities. The Customer may use them only to the extent necessary to use the Store. Reviews shared with the Seller are licensed in accordance with point 4.2. This section is based on the license provisions of your template.
12. Protection of personal data
We process personal data in accordance with the Privacy Policy available in the Store. Providing data is voluntary, but necessary for services (orders, contact, billing). The document reference and role are as in the template.
13. Changes to the Regulations and Communication
We may amend the Terms and Conditions for important reasons (changes in law, technology, scope of services). We publish the consolidated text in the Store at least 14 days in advance; changes do not apply to previously concluded contracts. We will inform you via a notice in the Store and/or email. The structure and terms are as in the template.
14. Customers who are not consumers
Different liability and jurisdiction rules may apply to B2B clients, to the fullest extent permitted by law. This does not apply to businesses with consumer rights. The clauses are based on the B2B arrangement in your document (moderated – without nominal amount limits).
15. Final provisions
15.1. We conclude contracts in Polish.
15.2. The content of the Regulations is available free of charge in the Store (you can download/save/print it).
15.3. In matters not regulated herein, Polish law and mandatory provisions applicable to consumers shall apply.
15.4. Nothing in this provision is intended to exclude or limit any consumer rights.
